2022 Terms and Conditions: New Orleans Salsa Bachata Festival, LLC
Release of Liability and Indemnity Agreement.
Your acknowledgment on this form states that you have chosen to participate in the New Orleans Salsa Bachata Festival. You acknowledge that you are going to take part in all or some of its dancing activities and/or other recreational activities at the New Orleans Marriott or any other facilities/locations chosen by NolaSBF for whatever activities. You understand that your participation in these activities in whatever capacity poses risks of injury and in some cases, death. Other risks include those associated with the use of the facilities, including walking around the hotel, properties, neighborhood (French Quarter/ Bourbon Street, travel to and from facilities, etc) and parking lots, and participating in dancing lessons, social dancing, dancing competitions, and special events (collectively, “use the facilities” and “locations”). Despite these risks and all other risks, and to the fullest extent allowed by law, you agree to assume all risks of injury or death that might be associated with or arise out of your participation with or simple attendance in the event or use of the facilities. You further understand that during your participation in the event you are solely responsible for knowing and understanding your own ability to dance, perform, work in any capacity with strenuous physical movements.
In consideration for being allowed to participate in the event and use the facilities, YOU AGREE TO RELEASE FROM ANY LEGAL LIABILITY AND AGREE NEVER TO SUE, New Orleans Salsa Bachata Festival, LLC or any of their parent companies, subsidiaries, owners, employees, agents, volunteers, dance instructors, and New Orleans Marriott for injury or death resulting from your participation in the event or the use of the facilities, regardless of the cause, to the fullest extent allowed by law, including alleged negligence. You further agree to defend, indemnify and hold harmless New Orleans Salsa Bachata Festival, LLC, doing business as NolaSBF, and parent companies, subsidiaries, owners, employees, agents, volunteers, dance instructors, and Astor Crowne Plaza Hotel French Quarter New Orleans for any claims, lawsuits, damages, attorney fees, costs or judgments for personal injury or personal property damage or theft related in any way to your participation in the event or use of the facilities and surrounding areas.
YOU UNDERSTAND THIS IS A RELEASE OF LIABILITY THAT IS VALID FOREVER, and will apply whenever you participate in the event or use the facilities/ surrounding areas at New Orleans Marriott. You understand that this RELEASE OF LIABILITY will prevent you, or your heirs from filing suit or making any claim for damages in the event of injury or death from your participation in the event or use of the facilities. Additionally, in the event that you file, or your legal representative files a claim or a lawsuit arising out of participation in the event or the use of the facilities at Astor Crowne Plaza Hotel French Quarter New Orleans, YOU AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS, New Orleans Salsa Bachata Festival, LLC doing business as NolaSBF for any damages, attorney’s fees or costs arising out of such a claim or a lawsuit. With a full understanding of this agreement, you nevertheless enter into this agreement freely and voluntarily and agree that it is binding upon you, your heirs, assigns and legal representatives. You understand and agree that this agreement is severable and that if any clause is found to be invalid, the balance of the contract will remain in effect and will be valid and enforceable.
Refunds and Exchanges
All sales are FINAL.
No refunds will be issued.
Before purchasing passes, carefully review your selection, price and dates of the event. In addition, we may occasionally offer passes at a discount after the original on-sale date and will not refund the difference between the original price and the sale price. You agree that you will not attempt to evade, avoid, or circumvent any refund prohibitions in any manner with regard to passes you purchased. Without limiting the generality of the foregoing, you will not dispute or otherwise seek a “chargeback” from the company whose credit card you used to purchase Passes from the site.
Should you do so, your passes may be cancelled, and we may, in our sole discretion, refuse to honor pending and future pass purchases made from all credit card accounts or online accounts on which such chargebacks have been made, and may prohibit all persons in whose name the credit card accounts exist and any person who accesses any associated online account or credit card or who otherwise breaches this provision from using the Site.
You may, however, transfer your pass to another person.

There is a $25 pass transfer fee for each pass that is transferred before July 15th, 2022 at 5:00PM.
No transfer requests will be processed without the transfer fee.
Cancelled and Postponed Events.
If our Event is cancelled you will receive an e-mail from Nolasbf@gmail.com. We will attempt to issue you a refund, unless your Pass is subsequently transferred to another person.
If the Event is moved or rescheduled, we reserve the right to set refund limitations.
Please contact us at Nolasbf@gmail.com for more information or to request a refund if you cannot attend the rescheduled event. Please make sure to include/provide your Invoice number so we can expedite your refund, if applicable.
If we issue you a refund for a pass, we will issue a refund of the pass’ face value paid (or, if a discounted Pass, then instead the discounted pass price paid), all service fees and any convenience charges will not be refunded. Also, if a refund is issued, it will be issued using the same method of payment that was used to purchase the pass. If a credit card was used to make the refunded purchase, then only that actual credit card will receive the credit for the refund. In the event that the form of payment is lost, refunding is forfeited.New Orleans Salsa Bachata Festival, LLC will not be liable for travel or any other expenses that you or anyone else incurs in connection with a cancelled or postponed event.
Pricing and Other Errors.
If the amount you pay for a pass is incorrect, regardless of whether due to an error in a price posted on our website or otherwise communicated to you, or you are able to order a pass before its schedule on-sale or pre-sale date, or you are able to order a pass that was not supposed to have been released for sale, then New Orleans Salsa Bachata Festival, LLC will have the right to cancel that pass (or the order for that pass) and refund to you the amount that you paid. This will apply regardless of whether because of human error, or a transactional malfunction of our website, or other operated system.
License; Ejection and Cancellation; No Redemption Value.
The Event Providers reserve the right, without refund of any amount paid or time devoted, to refuse admission to, or eject, any person whose conduct management deems disorderly, who uses vulgar or abusive language or who fails to comply with Event Provider rules. Breach of terms or rules will terminate your license to attend, or even participate in any capacity in, the event without refund. Any Event Pass is a revocable license and admissions may be refused.
Recording, Transmission and Exhibition.
You agree that the Event for which you purchase Passes is a public event, that your appearance and actions inside and outside the venue where the event occurs are public in nature, and that you have no expectation of your name, image, likeness, acts, poses, plays, appearance, movements, and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the event (regardless of whether before, during or after play or performance) for any purpose, in any manner, in any medium or context now known or hereafter developed, without further authorization from, or compensation to, you or anyone acting on your behalf, ever.
You Are Subject to Search.
You and your belongings may be searched on entry to the event.
You consent to such searches and waive any related claims that may arise. If you elect not to consent to such searches, you may be denied entry to the event without refund or other compensation. Under certain facility rules, certain items may not be brought into the premises, including without limitation, alcohol, drugs, controlled substances, weapons, laser pointers, strobe lights, irritants (e.g., artificial noisemakers), bundles and containers.
New Orleans City Code Chapter 66, Article II: Non Smoking Policy
Under the ordinance, smoking and vaping is prohibited in all indoor areas of hotels and motels, including lobbies, common areas, conference and meeting rooms, private offices, hallways, elevators, stairs, restrooms, pool areas, and 100% of guest rooms.
In addition, smoking and vaping is prohibited in outdoor areas that are considered to be “enclosed.” An area is considered enclosed if it is bounded by two or more walls (or other barriers) and a ceiling. There is no restriction on other outdoor areas.
In alignment with all IHG Hotels, the New Orleans Marriott is a smoke free hotel. The hotel is smoke free in all areas of the Hotel: lobby, guest rooms, restaurant, lounge, meeting and banquet facilities. To protect the smoke free environment, the Hotel will post a $250.00 cleaning fee to the account of any guests who smokes in their hotel room.
Please be advised that all of the above are held en force and further terms and conditions may apply and may be accessed via our website under the “General Terms and Conditions” tab. Your acknowledgement here states that you have read, understood, and therefore agree to the Terms and Conditions in their entirety.
